Résumé

With the fourth edition of the Annotated Code of Canon Law long out of print, it seemed necessary to prepare a fifth edition that would include all the changes that have taken place in recent years, paying particular attention to the developments arising from the XVI Ordinary General Assembly of the Synod of Bishops (October 2-27, 2024) on synodality in the mission of the Church. In reality, the synodal assembly merely confirmed the general structure of the Code promulgated in 1983, emphasizing the need to strictly observe the normative provisions on the participation of all the faithful in the mission of the Church and the need for pastors to activate the instruments of synodal participation already provided for in the canons.Therefore, in addition to preparing some specific comments on various canons, some texts had to be completely revised, as several motu proprio introduced changes to the canons, which required the adaptation of the related comments or others in the volume that referred to them. In this regard, the present edition contains in the Appendix the English text of the new Ap. Const. Praedicate Evangelium, which regulates the organization of the Roman Curia. As always, the opportunity was taken to update references to other normative or doctrinal texts that had arisen in the meantime.In line with the 1993 edition edited by Prof. Ernest Caparros, this fifth edition includes new commentaries on sections of the Code. The need for these updates provided an opportunity to incorporate the contributions of renowned professors from the Pontifical University of the Holy Cross, each in their respective areas of specialization. Thanks to their contributions, the volume contains original commentaries on juridical persons (cc. 113-128), prescription and reckoning of time (cc. 197-203), personal prelatures (cc. 294-297), associations of the faithful (cc. 298-329), societies of apostolic life (cc. 731-746), criminal proceedings (cc. 1717-1731), and administrative procedures (cc. 1732-1752).
